Three Years Compulsory Practice Experience for Judiciary Service – A Bane or Boon?

Abstract In a recent landmark judgment in All India Judges Association v. Union of India , the full bench of the Supreme Court has restored the three-year minimum courtroom practice as a prerequisite for entry into the civil judge (junior division) service. The reason behind making the three-year practice mandatory is to ensure that judges are adequately acquainted with the practical functioning of the judiciary before assuming their roles. The bench observed that the appointment of fresh law graduates has led to many problems, as evident from the affidavits of the High Courts. While the intent behind the ruling may appear reformative on the surface, a closer look reveals several deep-rooted concerns that could undermine the very objectives it seeks to achieve.
This piece acknowledges that experience is crucial for judges to perform competently. However, it questions whether the three-year mandatory practice rule, without sufficient structural support, flexibility, and safeguards, truly serves the interests of justice. By exploring the shortcomings in the judgment and offering constructive alternatives, this piece aims to engage with the broader question: Are we strengthening the judiciary, or are we merely establishing another gatekeeping mechanism that might deter bright, deserving individuals from joining it?
